肯尼亞標(biāo)準(zhǔn)局KEBS禁止二手服裝與二手鞋類產(chǎn)品進(jìn)入肯尼亞市場(chǎng)

      依據(jù)《肯尼亞標(biāo)準(zhǔn)法令》第496章（Standards Act Cap 496,laws of Kenya）和2005年7月發(fā)布 的《第78號(hào)進(jìn)口產(chǎn)品質(zhì)量法令》（Quality Imports Order No.78）,為確保進(jìn)口產(chǎn)品的質(zhì)量，為肯尼亞 消費(fèi)者提供安全、健康、環(huán)境等方面的保護(hù)，肯尼亞標(biāo)準(zhǔn)局（KEBS）于2005年9月29日開始實(shí)施出口 前標(biāo)準(zhǔn)符合性驗(yàn)證計(jì)劃（PVoC）。 

      在實(shí)施PVoC計(jì)劃之前，肯尼亞采取對(duì)進(jìn)口貨物實(shí)行到貨驗(yàn)證制度，但容易導(dǎo)致貨物進(jìn)港的延遲，而 且對(duì)于不合格的產(chǎn)品，KEBS還需將其遣返或以不污染環(huán)境的方式銷毀而造成額外負(fù)擔(dān)。因此，從2005年起開始采用PVoC這種出貨前驗(yàn)證的方式。 

市場(chǎng)準(zhǔn)入要求 

      肯尼亞標(biāo)準(zhǔn)局（KEBS）于2005年9月29日開始實(shí)施出口前標(biāo)準(zhǔn)符合性驗(yàn)證計(jì)劃（PVoC）。PVoC目錄內(nèi)的產(chǎn)品必須在出貨前獲得符合性證書（CoC），到港時(shí)提供給肯尼亞海關(guān)，否則將無法入境。如果沒有CoC 特殊情況下可由KEBS決定對(duì)該批貨物實(shí)施檢驗(yàn)，并處以罰款。 

適用范圍 

      標(biāo)準(zhǔn)符合性驗(yàn)證計(jì)劃PVoC覆蓋電子電器產(chǎn)品、玩具、汽車、食品、化學(xué)物品、紡織皮革、家具、建筑原料、二手產(chǎn)品等14大類。

認(rèn)證流程 

PVoC 包括以下關(guān)鍵要素： 

——貨物裝運(yùn)前檢查； 

——在具備認(rèn)可資格的實(shí)驗(yàn)室進(jìn)行檢測(cè)、評(píng)估； 

——審查產(chǎn)品生產(chǎn)過程； 

——文件符合性檢查； 

——對(duì)測(cè)試報(bào)告與標(biāo)準(zhǔn)符合性的審核。 

獲得PVoC認(rèn)證有三種方式： 

方式 a）：每批貨物檢驗(yàn)及測(cè)試出口商聯(lián)系所在國(guó)的PVoC辦事處，提交填寫好的認(rèn)證申請(qǐng)書（RFC）和本批貨物的形成發(fā)票，或者由肯尼亞進(jìn)口商提交進(jìn)口聲明表格（IDF）和形成發(fā)票復(fù)印件，啟動(dòng)PVoC過程。PVoC辦事處對(duì)貨物進(jìn)行檢驗(yàn)，確認(rèn)其是否滿足肯尼亞標(biāo)準(zhǔn)/技術(shù)規(guī)范的要求，并抽取樣品進(jìn)行測(cè)試，如果 測(cè)試結(jié)果合格，將根據(jù)進(jìn)口商提供的貨物最終發(fā)票頒發(fā)CoC證書（對(duì)于航空運(yùn)輸，允許根據(jù)形式發(fā)票頒發(fā)證書）。 方式a）的CoC證書有效期為90天，只對(duì)該批次的貨物有效。食品、藥品、化學(xué)物品只能使用方式a）。 

方式b)：產(chǎn)品注冊(cè)、檢驗(yàn)及有限測(cè)試如果同樣一種產(chǎn)品多次出口到肯尼亞，建議使用方式b）。出口商向PVoC登記、許可/認(rèn)證中心提出申請(qǐng)，提交產(chǎn)品符合肯尼亞標(biāo)準(zhǔn)/技術(shù)規(guī)范或國(guó)際標(biāo)準(zhǔn)的自我聲明，以及由按照ISO/IEC標(biāo)準(zhǔn)認(rèn)可的實(shí)驗(yàn)室出具的產(chǎn)品測(cè)試報(bào)告、ISO 9000 證書等技術(shù)支持文件。PVoC登記、許可/認(rèn)證中心審核出口商提交的文件，如發(fā)現(xiàn)問題，將要求整改。確認(rèn)產(chǎn)品滿足要求后，PVoC中心將頒布產(chǎn)品登記證。出貨時(shí)出口商應(yīng)向PVoC辦事處提交產(chǎn)品登記證復(fù)印件、認(rèn)證申請(qǐng)書和貨物的形式發(fā)票，PVoC辦事處同樣要對(duì)貨物進(jìn)行檢驗(yàn)，但只對(duì)個(gè)別批次抽樣測(cè)試。出口商還需提供貨物最終發(fā)票，PVoC辦事處審核各種文件后頒發(fā)CoC證書。產(chǎn)品登記證有效期1年，產(chǎn)品須持續(xù)滿足登記要求。如果產(chǎn)品進(jìn)行了修改，修改后的產(chǎn)品也必須相應(yīng)進(jìn)行產(chǎn)品登記證的修改。 

方式c)：產(chǎn)品認(rèn)可產(chǎn)品登記后如果質(zhì)量穩(wěn)定，在較長(zhǎng)時(shí)間內(nèi)持續(xù)滿足符合性要求，可向PVoC登記、許可/認(rèn)證中心申請(qǐng)?jiān)S可證。PVoC中心將審核產(chǎn)品的測(cè)試報(bào)告，必要時(shí)進(jìn)行補(bǔ)充試驗(yàn)。另外，還將對(duì)工廠的生產(chǎn)設(shè)施進(jìn)行檢查。經(jīng)過以上各步驟的審核后，制造商將獲得這種類型產(chǎn)品的許可證。以后產(chǎn)品在出口時(shí)，制造商只需要提供認(rèn)證申請(qǐng)書（RFC）、最終商業(yè)發(fā)票及許可證復(fù)印件，PVoC辦事處即可頒發(fā)證書，無需每次驗(yàn)貨和產(chǎn)品測(cè)試。為監(jiān)督產(chǎn)品的符合性，PVoC辦事處保留抽驗(yàn)已獲許可的產(chǎn)品的權(quán)利，但事先會(huì)通知出口商。如果產(chǎn)品持續(xù)滿足要求，許可證可以每年更新，更新時(shí)將對(duì)工廠的生產(chǎn)設(shè)施進(jìn)行監(jiān)督檢查。如果產(chǎn)品進(jìn)行了修改，須申請(qǐng)重新登記。 

提示： 

1．電網(wǎng)電壓230V，頻率50HZ； 

2．所有二手車輛須符合KS 1515：2000及其他肯尼亞標(biāo)準(zhǔn)或技術(shù)規(guī)范； 

3．集裝箱貨物需執(zhí)行封箱檢驗(yàn)。

肯尼亞KEBS開始為其合作的政府機(jī)構(gòu)監(jiān)管產(chǎn)品提供PVoC服務(wù)

根據(jù)2019年6月4日肯尼亞發(fā)布的政府公告OP/CAB9/83A，為了確保所有進(jìn)口到肯尼亞的產(chǎn)品都嚴(yán)格符合國(guó)家要求，由以下11家政府機(jī)構(gòu)監(jiān)管的貨物也將開始按照肯尼亞標(biāo)準(zhǔn)局KEBS（Kenyan Bureau of Standards）實(shí)施的出口前符合性評(píng)定方案 PVoC (Pre-Export Verification of Conformity)進(jìn)行管控。貨品在清關(guān)時(shí)需提供一張Enriched CoC，以證明該商品符合肯尼亞適用的有關(guān)標(biāo)準(zhǔn)和技術(shù)法規(guī)。
